Alchemy Studios’ Discretionary Rights Over NFT Land Titles and PCCs

Alchemy Studios may, in deviation from Section 3(e) of the User Terms, exercise its absolute discretionary right with respect to NFT Land Titles or Pre‑Construction Certificates (“PCCs”). Such discretion may be exercised only prospectively, meaning it will not affect any NFT Land Titles or PCCs already validly held by the User.

Except where a User has violated an Alchemy Studios guideline, policy, or any provision of the Alchemy Studios Terms, the exercise of this discretionary right shall occur without any obligation of notice, refund, compensation, or liability under this Appendix C or any other agreement, except where otherwise required by binding applicable law. All remaining provisions of Section 3(e) remain fully in effect.

User Statutory Rights & Refund Eligibility

If Vmax Brokers, The Realm, or any related service does not function as described, fails to perform, or is otherwise not in conformity with the User’s agreement with The Realm, the User may be entitled to statutory rights, remedies, or refunds under applicable law.

Nothing in the Alchemy Studios Terms shall be interpreted to limit or waive any non‑waivable statutory refund rights available to Users.
