The Agreement

You agree that you will be responsible for your use of the Services, and you further agree to defend and indemnify The Realm™ and the Affiliated Parties from and against every claim, liability, damage, loss, and expense, including reasonable attorneys’ fees and costs, arising out of or in any way connected with:
(a) Your access to, use of, or alleged use of the Services.
(b Your violation of any part of The Realm™ Terms, any representation, warranty, or agreement referenced in The Realm™ Terms, or any applicable law or regulation.
(c) Your actual or alleged violation of any third-party right, including any intellectual property right, publicity or privacy right, property right, or confidentiality obligation; or
(d) Any Dispute or issue between you and any third party. The Realm™ reserves the right, at The Realm™’s own cost, to take on the exclusive defense and control of any matter subject to indemnification by you (without limiting your indemnification obligations with respect to that matter), and in that case, you agree to cooperate with The Realm™’s defense of that claim.

Indemnification

Under this indemnification agreement, you are obligated to take responsibility for your use of the Services. Additionally, you agree to defend and indemnify The Realm™ and the Affiliated Parties against any claims, liabilities, damages, losses, and expenses. This includes reasonable attorneys’ fees and costs that arise from or are connected to several specific instances outlined below:

• Your access to, use of, or alleged use of the Services.
• (b) Your violation of any part of The Realm™ Terms, any representation, warranty, or agreement referenced in The Realm™ Terms, or any applicable law or regulation.
• (c) Your actual or alleged violation of any third-party right, including any intellectual property right, publicity or privacy right, property right, or confidentiality obligation.
• (d) Any dispute or issue between you and any third party.

The Realm™

retains the right, at its own cost, to assume the exclusive defense and control of any matter subject to indemnification by you. This does not limit your indemnification obligations concerning that matter. In such cases, you agree to cooperate with The Realm™’s defense of the claim. This indemnification agreement ensures that The Realm™ is protected from any legal issues that may arise from your use of the Services. It emphasizes the importance of adhering to The Realm™ Terms and maintaining compliance with applicable laws and regulations. Furthermore, it highlights the necessity of respecting third-party rights to avoid potential disputes. By understanding and accepting these terms, you help safeguard The Realm™ and its affiliated parties from any unforeseen legal complications.
